6. 0:00:54 — open the recording at 54 secondsMark Matheny (oversight board member): Just as our first formal meeting after kind of initially organizing, just wanted to encourage just all the board members, this is somewhat new for a lot of us, and I just want to challenge each of us as we go through this. We are an oversight committee, an investigative committee of sorts. Speak up, ask questions, challenge assumptions, challenge each other. I think that's healthy. That's what we are kind of entrusted to do. No bad ideas. Explore every option. And so with that, yeah, I think that was kind of the main thing. So with that, let's get started.

The House Bill 1515, when you read that in the legislature, It required us to elect a president and a treasurer. We have elected a president and a secretary, so I think it's prudent for us to elect a treasurer as well. Obviously, the county council approved $100,000 for this board to spend up to and hopefully under. I would think the treasurer's responsibilities would be working with the school corporation. I believe a fund has been established, we need to put a couple signers on that checking account,

And Jason O'Neill from Policy Analytics said that he wanted to send us a list of questions, I guess to kind of guide them, tell them what we were after. And I recently got a text from Tim Berry this morning that said they have a draft engagement letter for us, but that it's still in their legal review process. That's where we're at with that.

Kind of segueing into the next topic here on legal counsel, we've talked with a number of firms in town and in Indianapolis. Barnes and Thornburg is very interested in an engagement to represent our committee. The holiday is a terrible time to try and get engagement letters pushed through and approved. But I checked in with Jake German, the partner we'd be potentially engaging with from Barnes and Thornburg this morning. We cleared conflict of interest check with them. They're very interested. He's well versed in municipal law, specifically in municipal finance as well.

But I think we've structured things probably appropriately. the school board or the school corporation's going to be the most prepared to present immediately and you know for that reason we put them first and hopefully we can get the finance side working

So just for anybody that has not seen that and really wants to see the most current, most up-to-date, have an opportunity to maybe get some of the things that are lingering in their minds, that's going to be a great opportunity to hear that plan directly from Dr. Hemsall. And I want to thank Dr. Hemsall as well just for making himself available.

I think the goal is of having, you know, a public comment policy, right, is we want to walk this line of we want public input. We want to know what you're thinking. But just for time's sake, we have to do it in a very efficient manner. And so we will have attached to each agenda for each meeting on the back page. We will have the public comment policy. I've sent it to the board, each board member about a week ago. So I would look for a motion to adopt that, approve that. And then I'll just have it attached to each.

Indiana's Open Door Law 514.1.5 ensures public access to government meetings requiring notice and open sessions, but it does not guarantee a right for citizens to speak. Rather, it allows observation with specific rules for public comments set forth by the local board who can limit duration and manage any disruptions to maintain order focusing on transparency while preventing meeting chaos the Beagle County Oversight Board has adopted the following policy that will apply to all

That is, and again, by definition, a majority of our group. So if more than two of us, we are required to have it posted 48 hours in advance with an agenda, meeting in a public space, and available for public attendance. Public access, but speaking is not guaranteed. Citizens have the right to attend and record, but the law doesn't inherently grant a right to speak, though the oversight board may allow.

Rules are as follows. So citizens must be recognized by the presiding officer to speak. Citizen may be granted up to three minutes per meeting. Comments and questions should be relevant to the agenda item being discussed. and disruptive or disrespectful behavior, yelling, interruption, etc. will lead to a warning first and then potential removal from the meeting to ensure order.
